Required Automobile Insurance Coverage Amounts in Virginia
For all policies effective on or after January 1, 2022, minimum automobile liability insurance coverage has increased from $25,000.00 per person to $30,000.00 per person, and the per accident limitations have increased from $50,000.00 to $60,000.00. This means that for a minimum coverage policy in Virginia, an insurance company will pay up to $30,000.00 per injured party, but no more than a total of $60,000.00 for all injured parties in a single accident.
The minimum coverage amounts for uninsured and underinsured motorist coverage has also increased, with the same minimum limits. This means that policies issued in Virginia must provide uninsured and underinsured motorist coverage in the amount of $30,000.00 per person but no more than $60,000.00 for all injured parties in a particular accident.
What Is the Difference Between Uninsured Motorist Coverage and Underinsured Motorist Coverage?
Uninsured motorist coverage provides you with a source of recovery in the event that you are injured by an uninsured driver. Underinsured motorist coverage provides you extra protection when you are injured by a negligent driver who does not have as much insurance coverage as you do. For example, if the negligent driver only has the minimum amount of liability coverage of $30,000.00, and you have underinsured motorist coverage of $100,000.00, the negligent party's insurance company will pay the first $30,000.00 of your claim and your insurance coverage will pay the next $70,000.00 of your claim (to get your total recovery to $100,000.00).
